“Because marijuana now has currently accepted medical use in treatment in the United States, in 20 states, marijuana’s federal classification must be updated. In fact, because lack of accepted medical use in treatment in the United States is a statutory condition for schedule I, marijuana is not legally classified at all right now. This would be grounds for a motion to dismiss a federal criminal indictment for accepted state medical use.”
